NC Rule Change: Good or Bad?
What do you think about the NC Real Estate Commission’s decision to make written notice of agent bonuses to buyers? Personally, I think it’s a great idea because it’s basically putting in writing what we already spend the time to disclose to our buyers and sellers orally and if one doesn’t take the time to do this, then that is precisely why this rule is needed in the first place.
This way, it seems more “solid,” more “legal,” if you will. There is no way for buyers to say that they weren’t aware of the bonus if you’ve got it in writing. I’ve always felt like my clients might question why the disclosure wasn’t in writing, as if I were accepting some sort of shady bonus that wasn’t really owed to me.
I think that skeptics of the proposed written disclosure may simply dislike doing the additional paperwork or feel that it will be just another piece of unnecessary paper to add to the client’s file. I can’t imagine why else one would have a problem with putting the disclosure of an agent bonus in writing, can you?
